Marvin Wilson has an IQ of 61, putting his measured intelligence below the benchmark of mental retardation in Texas. The only evidence directly linking him to the murder for which he was imprisoned is a testimony from the wife of his partner in crime. Nothing about this case says "innocent until proven guilty."
In 2002, the Supreme Court declared that executions of mentally retarded criminals are "cruel and unusual punishments." However, Texas uses their own mental capacity standards to determine mental retardation. Rather than using clinicians, psychologists or scientists, Texas courts take an inmate's ability to work as an intelligence measurement.
Marvin Lee Wilson was able to work in construction, so they say he has no mental disability -- even though he has an IQ below the legal standard and was diagnosed by a mental retardation specialist. How is this logical?
